These Resume Upload Terms & Conditions (“Terms”) apply to all users who upload, submit, create, or provide a resume, curriculum vitae (“CV”), profile, or other employment-related information (“Resume”) through JawatanKosong.com.

By uploading or submitting your Resume, you acknowledge that you have read, understood, and agreed to these Terms and the applicable Privacy Policy of JawatanKosong.com.

1. Purpose of Resume Submission

JawatanKosong.com provides resume submission and job-matching services to assist job seekers in finding potential employment opportunities.

Your Resume and related personal information may be collected, stored, processed and used for legitimate recruitment and employment-related purposes, including:

• processing job applications;

• matching your qualifications and experience with suitable employment opportunities;

• contacting you regarding potential job opportunities;

• assisting with recruitment and placement activities;

• providing your Resume or relevant information to prospective employers where appropriate and permitted; and

• improving our recruitment and job-matching services.

Uploading a Resume does not guarantee employment, interviews, job offers, responses from employers, or successful placement.

2. Accuracy of Information

You are responsible for ensuring that all information contained in your Resume and profile is truthful, accurate, complete and reasonably up to date.

You must not:

• provide false or misleading information;

• impersonate another person;

• falsify employment history, qualifications, licences, certifications or experience;

• upload a Resume belonging to another person without proper authorisation; or

• intentionally conceal or misrepresent material information relevant to an employment application.

JawatanKosong.com reserves the right to remove, suspend or reject any Resume or account containing suspected false, misleading, fraudulent or inappropriate information.

3. Personal Data and Consent

By uploading or submitting your Resume, you consent to JawatanKosong.com collecting, recording, storing, processing and using the personal information contained in your Resume and account for recruitment, job-matching and employment-related purposes.

Your personal data may include information such as your:

• name;

• contact number;

• email address;

• location;

• education;

• employment history;

• skills;

• professional qualifications;

• expected salary;

• employment preferences; and

• other information voluntarily included in your Resume or profile.

Personal data will be handled in accordance with applicable Malaysian personal data protection requirements, including the Personal Data Protection Act 2010 (“PDPA”), where applicable.

4. Sharing with Prospective Employers

Where necessary for recruitment or job-matching purposes, JawatanKosong.com may disclose or provide your Resume and relevant information to prospective employers, recruiters or authorised parties involved in recruitment.

By using our job-matching services, you acknowledge that such disclosure may be necessary to introduce you to suitable employment opportunities.

We will take reasonable steps to limit the use of Candidate information to legitimate recruitment and employment-related purposes.

Once your Resume or information has been legitimately provided to or obtained by a prospective employer or other authorised recipient, JawatanKosong.com may not be able to control, retrieve or delete copies independently retained by that recipient.

5. Resume Visibility and Job Applications

Depending on the functions available on JawatanKosong.com, your Resume may be used when you:

• apply for a job;

• request job-matching assistance;

• submit your Resume directly to JawatanKosong.com; or

• otherwise authorise your information to be considered for employment opportunities.

Where privacy or visibility settings are provided, you are responsible for selecting the settings appropriate to you.

6. Sensitive and Unnecessary Personal Information

For your safety and privacy, you should not include unnecessary sensitive or confidential information in your Resume.

In particular, please do not include:

• your full NRIC/MyKad number;

• passport number;

• bank account details;

• credit or debit card information;

• online banking information;

• passwords;

• PIN numbers;

• One-Time Passwords (OTP); or

• other financial or authentication information not reasonably required for recruitment.

JawatanKosong.com will never require your online banking password, card PIN or OTP as part of a normal job application.

7. Third-Party Personal Information

If your Resume contains personal information belonging to another person, including referees, emergency contacts or references, you are responsible for ensuring that you have the appropriate permission or lawful basis to provide such information.

You should avoid providing unnecessary personal information about third parties.

8. Employer Use of Candidate Information

Employers, recruiters and other authorised users who access Candidate information through JawatanKosong.com must use such information solely for legitimate recruitment, hiring and employment-related purposes.

Candidate information must not be:

• sold or resold;

• publicly distributed without authorisation;

• used for unrelated marketing or advertising;

• used for spam or unsolicited commercial communications;

• used for fraudulent or unlawful purposes; or

• disclosed to unauthorised third parties.

JawatanKosong.com reserves the right to suspend or terminate access where misuse of Candidate information is suspected.

9. Job Scam and Recruitment Safety

Job seekers should exercise reasonable caution when communicating with employers or recruiters.

You should be cautious of any party requesting:

• payment to secure a job;

• money transfers;

• banking passwords;

• OTPs;

• credit or debit card information; or

• other unusual financial or confidential information.

If you encounter a suspicious job advertisement, employer or recruitment request through JawatanKosong.com, please report it to us promptly.

JawatanKosong.com reserves the right to investigate, suspend, remove or report suspicious or fraudulent activity to the relevant authorities where appropriate.

10. Security of Personal Information

JawatanKosong.com will take reasonable administrative, organisational and technical measures to protect personal information under our control against unauthorised access, misuse, loss, alteration or disclosure.

However, no internet-based system or electronic transmission can be guaranteed to be completely secure. Users should therefore exercise reasonable care when providing personal information online.

11. Updating or Removing Your Resume

You should keep your Resume and profile information reasonably current.

Where account functions are available, you may update, replace or remove your Resume through your account.

You may also contact JawatanKosong.com to request access to, correction of or deletion of personal information held by us, subject to applicable legal, regulatory, operational and retention requirements.

Removal of a Resume from JawatanKosong.com does not necessarily remove copies previously and legitimately received or retained by employers or other authorised recipients.

12. Data Retention

JawatanKosong.com may retain your Resume and personal information for as long as reasonably necessary for recruitment, job-matching, account administration, legal compliance, dispute resolution, fraud prevention or other legitimate purposes.

Personal information that is no longer required will be deleted, destroyed, anonymised or otherwise handled in accordance with applicable requirements and our data retention practices.

13. No Guarantee of Employment

JawatanKosong.com provides a platform and recruitment-related services to connect job seekers with potential employment opportunities.

We do not guarantee:

• that uploading a Resume will result in employment;

• that an employer will contact you;

• that you will receive an interview;

• that you will receive a job offer;

• the accuracy of every representation made by an employer; or

• the suitability of any particular job or employer.

Recruitment and hiring decisions are ultimately made by the relevant employer.

14. Candidate Responsibility

You are responsible for evaluating employment opportunities and deciding whether to communicate with, apply to, interview with or accept employment from any employer.

Before accepting employment, you should independently verify important information such as the employer, job responsibilities, salary, working location, employment terms and other relevant conditions.

15. Prohibited Content

You must not upload a Resume or document containing:

• unlawful content;

• malicious software, viruses or harmful files;

• fraudulent or deliberately misleading information;

• offensive or abusive content;

• material that infringes intellectual property or privacy rights; or

• information that you are not legally entitled to disclose.

JawatanKosong.com may remove such content without prior notice where reasonably necessary.

16. Suspension or Removal

JawatanKosong.com reserves the right to reject, remove or restrict access to a Resume, profile or account where we reasonably believe that these Terms, applicable laws, platform policies or the rights and safety of other users may have been violated.

17. Limitation of Responsibility

To the extent permitted by applicable law, JawatanKosong.com shall not be responsible for losses arising solely from:

• inaccurate information voluntarily supplied by a Candidate;

• unauthorised information included by a Candidate in a Resume;

• an employer's independent recruitment or hiring decision;

• communications or transactions conducted outside JawatanKosong.com;

• misuse by a third party contrary to our Terms or instructions; or

• circumstances reasonably outside the control of JawatanKosong.com.

Nothing in these Terms excludes or limits any responsibility that cannot lawfully be excluded under Malaysian law.

18. Changes to These Terms

JawatanKosong.com may update these Resume Upload Terms & Conditions from time to time to reflect changes in our services, operational requirements, security practices or applicable laws.

The latest version will be published on JawatanKosong.com with the applicable revision date.

Your continued use of the Resume upload or job-matching services following an update constitutes acceptance of the revised Terms, to the extent permitted by law.

19. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Malaysia.

Any dispute arising from these Terms shall be subject to the jurisdiction of the courts of Malaysia.
