Terms and Conditions for Job Vacancy Advertisements

Welcome to www.jawatankosong.com (hereinafter referred to as "the Website") for posting job vacancy advertisements.

To ensure that all advertisements comply with relevant regulations and to provide a safe and efficient platform for recruiters and job seekers, please carefully read the following terms and conditions before posting an advertisement:


1. Responsibility for Advertisement Posting

  • The company or individual posting the job advertisement (hereinafter referred to as "the Advertiser") must ensure that all information provided is truthful, accurate, and does not contain any misleading, false, or fraudulent content.
  • The Advertiser shall be fully responsible for the legality and compliance of the job advertisement content, including but not limited to the job description, salary, benefits, requirements, and other related information.
  • The Website does not accept job advertisements from any illegal companies or institutions, including but not limited to illegal moneylenders, unauthorized financial services, fraudulent organizations, or any other entities operating in violation of the law.


2. Content Regulations

  • Job advertisements must not contain any content that violates laws, regulations, or social moral standards. Advertisements must not include discriminatory, unfair, or offensive language, including but not limited to discrimination based on gender, race, religion, age, or disability.
  • The advertised job must be a real and genuine position; fictitious or fabricated job information is strictly prohibited.
  • The Advertiser shall ensure that all submitted materials (texts, images, logos, trademarks, or other content) do not infringe upon any third-party intellectual property rights. Any infringement claims shall be the sole responsibility of the Advertiser, and the Website shall not be liable.


3. Prohibited Actions

  • It is strictly prohibited to post job advertisements from illegal companies or organizations, including but not limited to illegal moneylenders (loan sharks), pyramid schemes, fraudulent organizations, illegal gambling, or unauthorized financial activities.
  • Fraudulent or improper solicitation of job seekers is strictly prohibited.
  • It is forbidden to post any job that may cause harm, threats, or insecurity to job seekers.
  • Advertisements involving pyramid schemes, multi-level marketing (MLM), exploitative jobs, or illegal recruitment are not allowed.


4. Advertisement Posting Duration and Removal

  • The validity period of each advertisement is determined according to the Website’s policies. Advertisements will not automatically expire; the Advertiser must notify the Website to manually take down or extend the posting period.
  • The Website reserves the right to remove or suspend any advertisement at any time if it has expired, violates the rules, receives complaints, or is deemed suspicious, without prior notice to the Advertiser.
  • Advertisers may request early removal of advertisements; however, fees paid are strictly non-refundable.


5. Advertisement Review

  • The Website reserves the right to review all job advertisements. Any advertisement that does not comply with the Website’s policies may be rejected or removed at any time.
  • The Website reserves the right to modify or remove inappropriate advertisements without prior notice.


6. Data Protection and Privacy

  • The Advertiser must comply with the Personal Data Protection Act (PDPA) or other relevant privacy laws. Any personal information collected through the advertisement shall only be used for recruitment purposes and must not be used for any other purposes without explicit consent.


7. Advertisement Fees and Refund Policy

  • The Advertiser must pay the applicable fees for posting advertisements in accordance with the Website’s policies.
  • Once an advertisement is published, the fees are strictly non-refundable, unless a technical issue within the Website prevents the advertisement from being displayed.


8. Technical Service Limitations and Disclaimer

  • The Website does not guarantee uninterrupted 24/7 service. In cases of interruptions caused by third-party service providers (e.g., telecommunications companies, hosting providers), the Website shall not be held liable.
  • In the event of technical issues, system maintenance, server failure, or unforeseen disruptions causing temporary unavailability of the Website, the technical team will work to restore services as soon as possible. The Website shall not be liable for any direct or indirect losses, including but not limited to advertisement exposure interruptions, candidate drop-offs, data delays, or business disruptions.


9. Disclaimer

  • The Website is solely a platform for publishing job advertisements and does not participate in any part of the recruitment process.
  • Any disputes between Advertisers and job seekers shall be resolved independently, and the Website shall not bear any liability.
  • Job seekers are responsible for verifying the accuracy of the information and making independent decisions regarding job applications.


10. Obligations of Advertisers

  • Advertisers are required to ensure that all job information is truthful, lawful, and up to date. Advertisers must promptly notify the Website to remove advertisements once positions are filled or no longer valid.
  • If an advertisement is found to be false, illegal, or subject to complaints, the Website reserves the right to take immediate action, including removal of the advertisement or suspension of the account, without refund.


11. Governing Law and Dispute Resolution

  • These terms are governed by the current laws of Malaysia.
  • Any disputes arising from these terms shall first be resolved amicably through negotiation. If no resolution is reached, the dispute shall be submitted to the jurisdiction of the courts of Malaysia.


12. Right to Modify and Interpret

  • The Website reserves the right to modify these terms and conditions at any time. Any modifications shall take effect immediately and apply to all new postings as well as renewals of existing postings.
  • The Advertiser is responsible for regularly reviewing and complying with the latest version of the terms and conditions.
  • The Website reserves the final right of interpretation of these terms.


13. Promotions and Discounts

  • Agensi Pekerjaan Peluang Sdn. Bhd. reserves the full right and discretion to change, modify, add, or withdraw any promotional discounts or offers at any time without prior notice.
  • All decisions by Agensi Pekerjaan Peluang Sdn. Bhd. regarding promotions, discounts, vouchers, and privileges are final and binding.


14. Force Majeure Clause

In the event that the Website ceases operation, undergoes merger, acquisition, sale, or is affected by force majeure (including but not limited to natural disasters, wars, government policies, pandemics, cyberattacks, or network disruptions), the services and related packages shall be terminated accordingly. The customer shall not be entitled to any refund or compensation of any kind.
